I, the below signed, AGREE TO THE RULES AND ASSUME ALL RISK OF INJURY that I may sustain on the premises of Dis & Dat Auto Recycling @ 2635 Bledsoe Lane, Las Vegas, NV 89156, and do for myself, my heirs and personal representatives forever release and discharge the owners, operators, and employees of said business and property from any actions, suits, damages, claims, or judgments that may result from any personal injury while on the premises or in the use of any equipment of said business for the removal of parts by me or at my direction. I acknowledge that the yard contains hazards including but not limited to: sharp metal edges, broken glass, unstable vehicles on stands, heavy falling parts, slippery surfaces (oil/fluids), and the use of heavy machinery nearby.

INDEMNIFICATION AND HOLD HARMLESS: I agree to indemnify, defend, and hold harmless Dis & Dat Auto Recycling, its owners, officers, and employees from and against any and all claims, lawsuits, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or resulting from my presence on the premises or my activities in the yard. This includes, but is not limited to, any injury or damage I may cause to other customers, third parties, or the property of Dis & Dat Auto Recycling.

COVENANT NOT TO SUE: I, for myself and on behalf of my heirs, executors, and assigns, hereby agree and covenant that I will not at any time, directly or indirectly, institute, maintain, or prosecute any action, suit, or proceeding at law or in equity against Dis & Dat Auto Recycling, its owners, agents, or employees, for any injuries, deaths, or property damage arising out of my presence on the premises or my use of the facilities and tools, whether caused by the negligence of the Releasees or otherwise. I further agree that if I or anyone on my behalf violates this covenant by filing a lawsuit, I shall be liable for all attorney fees and legal costs incurred by Dis & Dat Auto Recycling in defending such action.

GOVERNING LAW AND EXCLUSIVE VENUE: This Agreement shall be governed by, and construed in accordance with, the laws of the State of Nevada, without regard to its conflict of law principles. I irrevocably agree that the exclusive venue for any action, suit, or proceeding arising out of or relevant to this Agreement, or my presence at Dis & Dat Auto Recycling, shall be the state or federal courts located in Clark County, Nevada. I hereby waive any objection to such jurisdiction and venue, including any defense based on forum non conveniens (inconvenient forum)

SEVERABILITY: If any term, provision, covenant, or condition of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. The parties further agree that any such invalid provision shall be modified by the court to the minimum extent necessary to make it enforceable.

RULES:

  • You must be 18 years or older to enter the yard
  • No cutting torches
  • No alcoholic beverages or drugs
  • No pets, only certified handicap service animals
  • No weapons, firearms or destructive devices
  • Toolboxes & Bags will be inspected upon entering and exiting the yard
  • ALL THEFT or VANDALISM WILL BE PROSECUTED ACCORDING TO LAW
  • Vehicles cannot be repaired in the parking lot of Dis & Dat Auto Recycling
  • Dis & Dat Auto Recycling reserves the right to refuse admittance to anyone that may represent a safety concern to themselves or others
  • Anyone not following the safety policies will be asked to leave immediately
  • I acknowledge that Dis & Dat Auto Recycling recommends the use of safety glasses, gloves, and steel-toed boots, and I assume all risk associated with my choice of attire/protection.
  • NO GUARANTEE OR WARRANTY OR RETURNS ON ANY PARTS SOLD. All parts are sold ‘AS IS, WHERE-IS’ with no warranties, express or implied, including the warranty of merchantability or fitness for particular purpose.  Dis & Dat Auto Recycling is not responsible for import installation or any damages/accidents resulting from the use of used parts.
  • AIR BAG(s) ARE SOLD AS IS. THERE IS NO GUARANTEE OR WARRANTY!
